DIGITAL PRODUCT End User License Agreement (EULA)
THIS DIGITAL PRODUCT IS LICENSED, NOT SOLD. BY POSSESSING, OR OTHERWISE USING THE DIGITAL PRODUCT, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, THEN YOU ARE NOT PERMITTED TO POSSESS OR USE THE DIGITAL PRODUCT.
This DIGITAL PRODUCT, and all files and the content within those files that are delivered to you by https://ahmadwehbe.com, including updated versions, as well as all printed materials and electronic documentation (“Manuals”), together with any and all copies and derivative works of the DIGITAL PRODUCT and Manuals (collectively, the “Product”) is the copyrighted work of Ahmed Ibrahim Wehbe (“Owner”). Any use of the Product is governed by the terms of this end user license agreement (the “EULA”). The Product is distributed solely for use by authorized end users according to the terms of this EULA. Any use, reproduction, modification or distribution of the Product not authorized by the this EULA is prohibited.
LIMITED USER LICENSE
If you purchased or downloaded this Product legally from https://ahmadwehbe.com, and accept this EULA in its entirety, then you are hereby granted by the Owner a limited, non-exclusive, non-sublicensable, non-transferable license to use a copy of the Product for your non-commercial purposes (see Special Permissions and Limitations). This license is further limited by the following terms: a) you may not copy, reproduce, translate, reverse engineer, extract; source code; text; images, modify, decompile, or create derivative works based on the Product or any files that are part of the Product, b) you may not use cheats, automated actions, hacks, or any unauthorized third-party software to modify the Product, c) you may not use this Product or any of its parts for any commercial purpose without the Owner’s written permission (see Special Permissions and Limitations). d) you may not sell, re-sell, sublicense, rent out, lease or transfer any copy of the Product or your rights to the Product to any other party in any way not authorized herein (see Special Permissions and Limitations).
SPECIAL PERMISSIONS AND LIMITATIONS
For Products purchased or downloaded from https://ahmadwehbe.com:
These special permissions only apply if you have purchased or downloaded this Product from https://ahmadwehbe.com. If you have purchased or downloaded this Product from https://ahmadwehbe.com and accept this EULA in its entirety, then; a) you may create copies of this Product for the purpose of storing backups, b) you may lend out a copy of the Product to your family and relatives, granted that they accept this EULA first, however, they may not lend out a copy of this Product unless they purchase or download their own copy from https://ahmadwehbe.com and accept this EULA first.
For Tools or Assets (such as PenFroth™):
In the case where the product is a Tool or Asset, the following additional permissions apply to the content you create using said Tools and Assets: a) the content you create is your own property and you may sell the content you created without attributing the Owner of the Tools and Assets.
For Video Games:
In the case where the Product is a Video Game, the following additional limitations apply across all our video games no matter the source, platform, or marketplace the video game was obtained from: a) you may not publish video footage or livestream any content from our video games without the Owner’s written permission, b) you may only publish video footage or livestream content from our video games only if you are reviewing the game, c) the cumulative total, of the published video footage or livestreamed content from our video games, may not be longer than three minutes, d) the content, of the published video footage or livestreamed content from our video games, may not reveal secret locations, undisclosed bosses or any other content that might spoil the game experience of others who have not yet played the video game themselves, e) publishing tutorials, walkthroughs, and guides is not permitted in any medium (be it video, written, or imagery).
LIMITED WARRANTY
THE PRODUCT IS PROVIDED “AS IS”, WITH ALL FAULTS AND WE EXPRESS NO REPRESENTATIONS OR WARRANTIES OF ANY KIND RELATED TO THE PRODUCT AND/OR ANY RELATED FILES. THE USE OF THE PRODUCT IS AT YOUR OWN RISK. NO INFORMATION (ORAL OR WIRTTEN) GIVEN BY US SHALL BE USED AS ADVICE OR CREATE A WARRANTY. WE DISCLAIM ALL WARRANTIES WITH RESPECT TO THE PRODUCT, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF CONDITION, UNINTERRUPTED USE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO YOUR ACCESS, USE, MISUSE, OR INABILITY TO USE THE PRODUCT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ACKNOWLEDGE THAT WE DO NOT REPRESENT OR WARRANT THAT THE PRODUCT WILL BE ACCESSIBLE WITHOUT INTERRUPTION OR THAT THE PRODUCT IS FREE FROM ERRORS, DEFECTS, DESIGN FLAWS, OR OMISSIONS.
LIMITATION OF LIABILITY
WE, https://ahmadwehbe.com AND/OR THE OWNER SHALL NOT BE HELD LIABLE IN ANY WAY FOR ANY HARDWARE OR SOFTWARE DAMAGE, LOSS, OR INTERRUPTION OF ANY KIND ARISING OUT OF ANY USE OF THIS PRODUCT, INCLUDING WITHOUT LIMITATION LOSS OF DATA, COMPUTER FAILURE, OR ANY OTHER DAMAGE, LOSS, OR INTERRUPTION, NOR FOR ANY DAMAGE, LOSS, OR INTERRUPTION TO ACCOUNTS, STATISTICS, RANKS, OR PROFILE OR USER SETTINGS STORED BY THE PRODUCT.
INDEMNIFICATION
You agree to defend, indemnify and hold us, https://ahmadwehbe.com and the Owner harmless from and against any claim, liability, loss, injury, damage, cost or expense including court, attorney and travel fees arising out of or from; a) your use of the Product, b) your violation of any provision of this EULA.
TERMINATION
If you fail to comply with this EULA then you must destroy all of your copies of this Product. Not complying with this EULA will also terminate your right to download this Product and any future updates from https://ahmadwehbe.com.
MISCELLANEOUS
This EULA constitutes the entire agreement between you and the Owner in relation to your use of this Product, and supersedes all prior agreements and understandings. This EULA can be amended only by an instrument in writing signed by the Owner. If any part of this EULA is determined to be unlawful, void, or for any reason unenforceable, then that part shall, in favor of the Owner, be either rewritten or severed, and the rest of this EULA shall remain intact. No failure or delay in our decision to enforce any part of this EULA shall be interpreted as a waiver of our rights. These terms shall be governed by and interpreted in accordance with the laws of the Government of Sweden, and you submit to the exclusive jurisdiction of the state and federal courts located in Helsingborg, Sweden, for the resolution of any disputes.
YOU HEREBY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS EULA AND AGREE THAT BY CLICKING “ACCEPT” AND/OR BY USING THIS PRODUCT, YOU ACCEPT TO BE LEGALLY BOUND BY THE TERMS AND CONDITIONS DEFINED IN THIS EULA.
